"He is using the phone" does not sound natural to me. I would say "he is (talking) on the phone".

Agreed with "he", but "Someone's using the phone" would be OK in the context where you wanted to use it, for example.

The phrases "he is on the phone", " he is talking on the phone", and "he is using the phone", too, are all correct and are commonly used.
